The United States District Court for the District of Columbia has denied a motion by plaintiff Aaron Greenspan seeking limited discovery against Nigerian President Bola Tinubu and communications firm DCI Group in an ongoing Freedom of Information Act (FOIA) lawsuit involving the FBI and DEA.
?In an October 30 ruling, the Court held that Greenspan’s proposed discovery regarding alleged cyber attacks on his website was not sufficiently relevant to the central legal questions of the FOIA dispute.
?Attorney Christopher W. Carmichael praised the decision, noting that the Court reinforced critical procedural boundaries by ensuring FOIA proceedings are not used to pursue unrelated matters.
?In the same ruling, the Court denied a motion by nonparty Karl Von Batten to file an amicus curiae brief, rejected Greenspan’s request for judicial notice, and denied Greenspan's motion for summary judgment.
Attorney Oluwole Afolabi emphasized that while the core FOIA claims remain pending, these rulings clarify which issues are appropriate for consideration as the litigation proceeds.
